Conveyancing in Sydney for first home buyers
The role of a conveyancer or solicitor is to advise you on all the legal aspects of the sale when acting on your behalf. Your conveyance should be able to answer any questions you may have, advise you of your obligations and be able to offer sound pre-purchase advise which is why it is better to use a conveyance rather than try and do it yourself.
What your conveyance will do
The conveyancer acting on your behalf is duty bound to ensure that everything is above board with the property you are considering and in the case of first home buyers this is especially important as there may be aspects of purchasing a home that they are unaware of. Your conveyance will
- Obtain instructions from you in relation to the intended purchase
- Look into the source of finance to be used to purchase the property
- Review any special arrangements between the seller and buyer
- Review the proposed contract
- Check the title documents for any easements or other encumbrances
The conveyance will advise the buyer on the contents of the contract and clarify any points or liabilities that could affect the property.
It should be noted though that a solicitor or conveyance is not qualified to assess the value of a property or provide any advice regarding investments.
Conveyancing for first home buyers
First home buyers need to have a conveyance act for them as they are new to the process and will need to have a professional conveyancer acting for them. If you are applying for the First Home Plus stamp duty concession you will need to sign a declaration that you meet all the necessary conditions. The First Home Owner Grant Scheme is a NSW Government Incentive available to people buying or building their first home. It does not apply to vacant land and there are no income or assets tests to qualify.
The First Home Plus is also a NSW Government initiative which provides first home buyers with exemptions or concessions on transfer duty for eligible first home buyers. This grant includes vacant land purchase.
Advise your conveyance or lawyer if you are eligible for either as the exemptions will impact on the type of searches the conveyance would normally do.
